Terms of Service

1. The Service

Waitspot is a hosted waitlist tool that allows users ("project owners") to create a public signup page and collect email addresses from interested parties ("subscribers"). Core features — unlimited waitlist pages, referral links, CSV export, and embeddable forms — are available on the free plan at no cost. A one-time Pro upgrade is available per project for additional features (described below).

2. Accounts & Eligibility

• You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You may not share your account with others or create accounts on behalf of third parties without their consent.
• You must provide accurate information when creating your account.

3. Free Plan & Pro Upgrade

Free plan

The free plan is free forever and includes:

• Unlimited hosted waitlist pages.
• Unlimited subscriber signups.
• Built-in referral programme.
• CSV subscriber export.
• Embeddable iframe form.
• Confirmation and double opt-in emails (via your Resend account).
• Waitspot branding on your public signup page.

Pro upgrade ($20 one-time per project)

Paying the one-time Pro fee for a specific project unlocks:

• Removal of Waitspot branding from the public page.
• Custom email logo.
• Dropdown and radio button custom field types.
• Priority support.

The Pro upgrade is per-project (not per account) and is a one-time payment — there are no recurring subscription fees. Pro access persists for the lifetime of that project.

4. Payments & Refunds

Payments are processed by Stripe. All prices are in USD. By completing a purchase you authorise us to charge the amount shown at checkout.

Refund policy: You may request a full refund within 7 days of purchase, provided the upgraded project has collected fewer than 50 subscribers at the time of the request. Projects that have collected 50 or more subscribers on the Pro plan are not eligible for a refund, regardless of when the purchase was made — at that point the product has been meaningfully used. To request a refund, email team@waitspot.io with your project details. Requests outside these conditions are non-refundable.

5. Acceptable Use

You agree not to use Waitspot to:

• Collect personal data without subscribers' informed consent.
• Send unsolicited commercial email (spam) to subscribers.
• Build waitlists for illegal products, services, or activities.
• Impersonate another person or organisation.
• Attempt to gain unauthorised access to other users' projects or subscriber data.
• Use automated tools to generate fake signups or inflate referral counts.
• Interfere with or disrupt the service or its servers.
• Violate any applicable law or regulation, including data protection laws (GDPR, CAN-SPAM, CASL, etc.).

We reserve the right to suspend or terminate accounts that violate these rules at our sole discretion, without refund.

6. Your Data & Content

You retain ownership of all data you store in Waitspot, including your waitlist configuration and subscriber data. By using the service you grant us a limited licence to store and process that data solely for the purpose of providing the service to you.

You are responsible for ensuring that you have the legal right to collect the personal data of your subscribers and that you comply with applicable privacy and data protection laws when using subscriber data for your own communications.

You can export all subscriber data as a CSV at any time from your project dashboard. Deleting a project permanently and irreversibly removes all associated subscriber data from our systems.

7. Intellectual Property

The Waitspot name, logo, and service are owned by us and protected by intellectual property law. You may not use our trademarks or brand assets without prior written permission, except as permitted by the free plan's "Powered by Waitspot" branding (which you may keep or remove with a Pro upgrade).

We do not claim ownership of any content or data you upload or create through the service.

8. Uptime & Service Availability

We aim to keep Waitspot available and reliable, but we do not guarantee uninterrupted access. We may perform maintenance, updates, or emergency fixes that temporarily make the service unavailable. We will provide advance notice for planned downtime where practicable.

We are not liable for any loss or damage arising from service downtime or data loss, to the maximum extent permitted by law.

9. Disclaimers & Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, our total liability to you for any claim arising from or relating to these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim, or $20, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Termination

You may stop using Waitspot and delete your account at any time by contacting us at team@waitspot.io. Upon deletion, your projects and all subscriber data will be permanently removed.

We may suspend or terminate your access to the service if you violate these Terms, with or without notice. In the case of termination for cause, no refund will be issued for any Pro upgrades.

11. Changes to These Terms

We may revise these Terms from time to time. We will update the "Last updated" date at the top of this page and, for material changes, notify account holders by email. Continued use of Waitspot after revised Terms take effect constitutes your acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first. If that fails, disputes shall be subject to the exclusive jurisdiction of the courts in the applicable territory.
